Terms and Conditions

This is a contract between you and Milton Keynes Tours Limited (referred to as “MK Tours” and “us” here onwards in the document). MK Tours’s registered office address is Regus House, Atterbury Lakes, Fairbourne Drive, MK10 9RG. Outlined below are the terms and conditions of your booking with MK Tours. We request you to read them carefully as they set out our respective rights and obligations. Your contract with MK Tours is subject to English Law governed by the jurisdiction of the English Courts and is deemed to have been made at MK Tours office in Milton Keynes. In these terms and Conditions any reference to “you” and “your” covers the first named person on the booking along with all the other people named on the booking form. By making the booking the first named person agrees on behalf of all the people included in the booking that: –

He/She has read these terms and conditions, agrees to it and has authority to agree and be bound by them on behalf of the other people in this booking.

He/She is above the age of 18, a resident of UK and gives MK Tours the consent to use this information in accordance with our privacy policy

 

Booking:

A booking is made with MK Tours when a) you tell us that you would like to accept our written or verbal quotation; and b) you pay us a deposit as stipulated on your booking form, (If you are booking within 8 weeks of departure, full payment is due at the time of booking); and c) we issue you with a booking confirmation. We reserve the right to return your deposit and decline to issue a confirmation at our absolute discretion. A binding contract will come into existence between you and MK Tours as soon as we have issued you with a booking confirmation that will confirm the details of your booking and will be sent to you. You must check the confirmation carefully and raise any queries with MK tours immediately upon receipt. Any variation on stipulated payment terms shall be entirely at our discretion and shall be expressly agreed between us and noted on your booking form.

If your package includes a flight, we will issue you with an ATOL Certificate and a booking confirmation. Upon receipt, if you believe that any details on the ATOL Certificate or booking confirmation or any other document are wrong you must advise us immediately as changes cannot be made later and it may harm your rights if we are not notified of any inaccuracies in any document within 5 days of we sending it out

Our flights are ATOL protected. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. For further information, visit the ATOL website at www.atol.org.uk.

Prices:

We reserve the right to change the package price at any time without prior notice and you will be informed accordingly. The reasons for this could be (but not limited to) the airline ticket may be increased in case airline imposes any surcharge, if tickets are not issued on given time limit. The price may be increased if government imposes any charges pertaining to your travel. The package price may also be increased in result of change in prices by our suppliers in Saudi Arabia (hotels, transport etc.), due to any changes in Tax or any exchange rate fluctualtions.in such cases increase up to 2% will be absorbed by us. But if the increase is more than 2%, you have right to cancel your package and claim full refund, subject to refund charges of airline tickets.

Alternatively, you may choose to pay for your package in full at the time of booking, in which case The Company will fix the price and no charges or increase will be made

Travel insurance is not included as part of your package price. We are legally obliged to advise you to take out adequate travel insurance which suits your personal requirements.

 

Payment:

Full payment must be made to MK Tours at least 8 weeks prior to departure. Payment may be made by bank transfer or cheque (provided within the time to clear a cheque). Please note your booking may be cancelled if you fail to make full payment on time and if it is, cancellation charges as set out in “Cancellations” paragraph below will be payable by you

 

Changes/Alternations:

If you wish to change any part of your booking arrangements after our booking confirmation has been issued, you must inform MK Tours in writing as soon as possible. This should be done by the first named person on the booking. Whilst we will do our best to assist, we cannot guarantee that we will be able to meet your requested change. Where we can meet a request, all changes will be subject to payment of an administration fee of £25 per person per change as well as any applicable rate changes or extra costs incurred as well as any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers. You should be aware that these costs could increase the closer to the departure date that changes are made, and you should contact us as soon as possible. Where we are unable to assist you and you do not wish to proceed with the original booking we will treat this as a cancellation by you. A cancellation fee may be payable.

Note: Certain arrangements may not be amended after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements.

 

Cancellation from your side:

If you wish to cancel your booking, the first named person who signed the booking must notify us in writing as soon as possible. The charges will apply from the date on which written notification is received by us.

The Charges will be as following:

  • The deposit which is paid upon booking is non- refundable.
  • Cancellation more than 70 days before departure £250 per person.
  • Cancellation 69-50 days before departure 30% per person of package price. • Cancellation 49-16 days before departure 50% per person of package price.
  • Cancellation 15-0 days before departure 100% per person of package price. These percentages of the package price exclude any additional charges paid for insurance premiums/admin charges etc. which shall be forfeited in full.

Also note that once visas have been issued, no refunds can be issued in the event you cancel your arrangements.

If you have an independent travel insurance policy and you have cancelled because of a reason covered by that insurance of yours, then please follow the procedure laid down by the insurers and you might be able to reclaim the cancellation charges subject to any policy excess

Visas are non-transferable and. Due to the laws and regulations of Saudi Arabia, women are unable to travel to Saudi Arabia on their own and must be accompanied by a Mehram (male companion who is the woman’s husband, brother, son or father). In this case, if after the issuance of visas, the named Mehram on any booking is cancelling the trip, the entire booking will be treated as cancelled and no refund shall be given.

 

Complaints:

If you have any complaint whilst on your trip with us, you must bring it to the attention of our appointed representative or the member of staff or other supplier immediately so that action can be taken to rectify the problem. If you do not inform us about the complaint right away, we may not be able to resolve the problem locally and thus may not be able to deal with the issue effectively on your return.

If the problem cannot be resolved and you wish to complain further, you must send formal written notice of your complaint to us at our Milton Keynes office within 14 days of the end of your journey, giving your booking reference and all other relevant information. We shall investigate the matter, identify your concerns and get back in touch with you.

Failure to follow the procedure set out in this clause may affect ours and the applicable supplier’s ability to investigate your complaint and will affect your rights under this contract.

 

Your Behaviour:

All travelers with us are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the journey of others. If in our opinion or in the opinion of any our suppliers, airline crew, representatives, agents or any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to other traveler, or any third party or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking arrangements with us immediately. In the event of such termination our liability to you and/or your party will cease and you and/or your party will be required to leave your accommodation or other service immediately, and you will be responsible for your journey thereafter. We will have no further obligations to you and/or your party. No refunds for lost accommodation or any other service will be made, and we will not pay any expenses or costs incurred as a result of termination. You and/or your party may also be required to pay for loss and/or damage caused by your actions and your behaviour results in failing which is MK Tours are being forced to pay additional charges, we will seek to recover them in full from you.

 

 

What to expect:

Your Umrah package with us shall consist of your accommodation, flights to and from Saudi Arabia and transport within Saudi Arabia, along with any other services outlined in your booking form. The purpose of these Services is to allow you to complete the holy pilgrimage of Umrah in Saudi Arabia and as such you accept that this is by no means your normal leisure holiday package. You make your booking with us being completely aware of this.

Due to the large number of pilgrims in Saudi Arabia for the pilgrimage, the cities and towns are overcrowded. This has knock on effect on the public services, transport and accommodation within the country. You accept that the Services are at all times dependent on the Hajj Ministry and Saudi Arabian authorities within Saudi Arabia, over which we have no control. All accommodation is shared and star rating is provided by the hotels according to the Saudi Ministry of Trade standards and is quoted for guidance only; these are Saudi rated which are not British rating equivalent. You accept that accommodation may be of a lower standard than that expected.

 

Umrah Visa

We shall be applying for a visa on your behalf and our sole responsibility will be to submit your application, on your behalf. We have no control over the Saudi Embassy or any other authorities that are responsible for granting the applicable visa nor do we have any control over the visa application process and so we accept no responsibility for any delay or failure in any visa being granted. Passports can be rejected by the Saudi Embassy, misplaced or lost and incorrect visas can be issued but we can accept no responsibility for this or any consequences that you may suffer as a result.

Umrah visa charges can fluctuate and any increase in visa charges or associated fees in obtaining electronic visa authorisation (MOFA) will be applicable, and payable by you, at the date of visa submission to the Embassy; in accordance with our Booking Terms and Conditions.

You must provide us with your passport along with the photographs, Vaccination certificate and other documents communicated at the time of booking, no later than 30 days prior to your departure date, in order to allow sufficient time to complete the necessary procedures involved in obtaining a visa.

Disabilities/Special Needs and Medical Conditions

 Whilst we are not a specialist disabled holiday company, we will do our best to cater for any special requirements you may have. If you or any member of your party has any medical condition or disability which may affect your journey with us, please provide us with full details before we confirm your booking so that we can try to advise you as to the suitability of your chosen arrangements. If we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we may cancel it and impose applicable cancellation charges when we become aware of these details. We thus strongly advise you to please openly discuss any such special request and we shall do our best to accommodate your needs.

 

 

Beyond our Control

Alteration of Your Confirmed Booking:

In the unlikely event of we having to significantly change your arrangements or part of it, MK Tours will do its best to notify you at the earliest possible

Significant change includes the change of airport (except between airports serving the same city) or If the outward or return journey is rescheduled for more than 24hrs and shared with us by the airlines in well in advance of the journey

You shall be given the choice to accept the change and the contract will be varied to incorporate the change or to withdraw from the booking completely and we will make a full refund of payments made by you.

The factors affecting flights stopping at an airport en-route are not normally known in time for notification, such alteration is not regarded as a significant change and neither are changes in carrier or aircraft type. The Company is not liable to pay compensation where the changes are by reason of unusual circumstances beyond our control and which could not have been avoided by the exercise of all due care

Cancellation of the Package:

The cancellation may be necessary in exceptional circumstances. The company reserves the right to cancel your Umrah package. If this happens, you will be offered the choice of an alternative Umrah Package of comparable standard (if available) or full and prompt refund of all money you have paid.

If your Umrah package is cancelled as a result of low bookings, you will receive a full and prompt refund of all the payments made. No compensation is paid if your Umrah is cancelled because of circumstances beyond the company’s control as mentioned below.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control (“Force Majeure Event”).

Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid

A Force Majeure Event includes any act, event, non-occurrence, omission or accident beyond our reasonable control and includes, in particular (without limitation), the following:

Strikes, lock-outs, or Civil commotion, or other industrial action; riot, invasion, terrorist attack or Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; or Impossibility of the use of aircraft , motor transport or other means of public or private transport; or Impossibility of the use of public or private telecommunications networks.

Our obligations under these Terms are suspended for the period that the Force Majeure Event continues, and we will extend the time to perform these obligations for the duration of that period. We will take reasonable steps to bring the Force Majeure Event to a close or to find a solution by which our obligations under these Terms can be performed despite the Force Majeure Event

 

Foreign Office Advice

 

You are responsible for making yourself aware of Foreign Office advice and State Department warnings in regard to the safety of the countries and areas in which you will be travelling and to make your decisions accordingly. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure (see paragraph above “Beyond our Control”).

 

Data Protection Privacy Policy:

Any information about you or members of your group, including your names, contact details and any special needs, disabilities or dietary requirements are collected by the company, when you ask information or make a booking. It is your responsibility to ensure that other members of your group are aware of all booking conditions and policies.

Each person should agree to you making the deal on their behalf with MK Tours. We may disclose this information to our service providers (who may be located outside the UK/EU) for the purpose of providing you with your travel arrangements. The only minimum required information for this purpose will be disclosed. In the case of air travel, it may be mandatory for us to disclose information for security and anti-terrorism purposes, or any other purpose imposed on us by governments or airlines.

MK Tours may use your contact details and will share this among other group members as this will be used to create a WhatsApp group in order to share tour related information and updates. MK Tours shall also take photographs and make video for advertising purposes and interviews to share on our website and other online media like Youtube channel/Facebook page etc. MK Tours may disclose your information to companies who act as data processors on our behalf. The information, for example relating to your religion or health, may be sensitive personal data within the meaning of the Data Protection Act 1998. MK Tours needs this information to cater for your needs, but it is collected on condition that we have your consent. If you do not agree to the use of your information, we cannot accept your booking. MK Tours may contact you by post/Email with information about special offers or pilgrimages, if you do not wish to receive such information, please notify us. You have the right to ask the company in writing for a data request form to obtain a copy of the information, which the company holds about you.
